please help with a pshat if you can Todays Daf Kidushin 33b

The Gemoro says והביטו אחרי משה The stared behind Moshe "One (R. Yitzchok Nafcha*) is  Doresh this Pasuk לגנאי  They misbehaved  when they looked at Moshe כדאיתא as is 
mentioned."


The Gemoro doesn't elaborate what deplorable act they did.

Rashi explains that being they have done a דבר מגונה   (a deplorable act) the Gemoro doesn't want to publicize it.

Rashi continues that the Gemoro is referring to the Midrash Tanchuma (also Yerushalmi)
that the Bnai Yisrael looked at Moshe and said How fat are his legs how fat is his neck all this comes from us. (our money)

The question we (my Chavrusa) had:

Why would  Rashi publicize it when the Gemoro was careful not to publicize it?

If anyone can help us with a Pshat ,please do so.

טף למה באין, כדי ליתן שכר למביאיהן

The Gemoro asks why were the infants brought for the Mitzvah of Hakhel. The Gemoro answers, to give reward tothe ones who brought them. (the parents)
From this Gemoro it seems, there is no benefit for infants, to listen and absorb the learning. Otherwise, the simple answer  would have been they came to listen so to have the Torah absorbed in them.
 How do we explain Chazal ( Yerushalmi Yevamos 8b) The mother of Reb Yehoshua brought him in his crib  (infant) into the Bais Haknesess so his ears will be attached to Torah?

What Is Hachnasas Kallah ? -Daf Yomi-Megila 29A

Megillah 29a 

The term  “Mitzvas Hachnasas Kallah” is used today, as raising funds to marry off a Kallah.
In Shas the words הכנסת כלה has a different meaning.

Rashi explains L’hachnasas Kallah “ללותה מבית אביה לבית חופתה
(to accompany her from her fathers home to the house of the Chupa)

The actual Mitzva of Hachnasas Kallah is to  come and celebrate at the Chupa.

The Yosef Ometz writes:
"Mitzvah Gedolah of Hachnasas Kallah is one of the Mitzvos that have no shiur
(monetary donations do have a shiur) (Mishna Peiah 1:1 )
Most people are not makpid at all to be mekayam this Mitzvah. Even when they hear the announcement to come to the Chupa or they see the walking of the Kallah to the Chupa, They refrain to go even though they have no loss in money etc.—
Therefore it is very important to be diligent in this Mitzva Kalla (easy Mitzva) which has great rewards."

Fools In The Dark

The Gemoro says “If someone does both, the Chumros of Bais Shamai and also the Chumros of Bais Hillel, on him the Pasuk says,  
והכסיל בחשך הולך"

" And the fool in darkness he walks”.



My father a”h told me he heard from an Odom Gadol*, who asked:

Why did Chazal choose this Pasuk over all other Pasukim (for a Machmir like Beis Shamai and Beis Hillel.) 

He answered,* we find in Ms. Shabbos 18a,  according to Bais Shamai  who hold Shevisas Keilim is Deoreisa, then the only way to use a candelabrum on Shabbos, is, if he is Mafkir it, so that it doesn’t belong to him.

When he is Mafkir it he must exclude Goyim and Mechalellei Shabbos (otherwise they will take it for themselves)

This Hefker is valid only according to the Beis Shammai(Ms. Peiah 6 :1) who hold Hefker La’aniym ,Hefker. You may single out one group to whom you want to be Mafkir.

The Beis Hillel. argue, and hold it is only valid when you are Mafkir to everybody.

If you single out only to Aniyim it is not Hefker.

Therefore if someone will be Machmir like Beis Shamai  at Shevisas Keilim, he will need to be Mafkir the candelabrum and will also be Machmir like Beis Hillel. by Hefker, then  He has to be Mafkir to everybody. A Mechalell Shabbos or a Goy
will be able to take the candelabrum for themselves, and he will be walking around in his house in darkness.

*This is  only Al Pi Drush, and not Pshat. Rashi says the only time this applies is when the two Chumros or Kulos contradict each other. where they don't contradict each other, you may follow
two different Poskim, L'chumra or L'hokeil.

Can you write the Ketoires On A Klaf

Shulchan Aruch (Y.D. 283) :
You are not allowed to write one Parsha on its own, in the Torah. (except Tefillin & Mezuzos)

The Torah must be complete.

The Taz (sk2) writes the only Heter we have to write single Parshiyos, is for Children to learn (Eis Laasos Lashem). 

Mori V’rabi Hagaon R. Shlomo Miler shlita said, he can’t find a Heter to write a Ketores on a Klaf. A Segulah is not enough of a reason for "Heifeiroo Torasecha" In the Altneu Shul the Shivisi on the wall, is written in Roshei Teivos for the same reason.

הדלקה לאו עבודה

In Hilchos Chanukah we pasken   הדלקה עושה מצוה whereas according to the Rambam ,
at the Bais Hamikdash , a   זר  may light the Menorah.( even Lekatchila)  The way it would
be done , by taking the Menorah out and have the זר light and then return it back to it’s place. 

The obvious question  , if at the Bais Hamikdash we pasken הנחה עושה מצוה ,
Why for Chanukah do we pasken   הדלקה עושה מצוה ?

The Rogatchover Gaon zt”l says “in the times Of Bayis Sheini when there was no Shemen Hmishcha the way to be mekadesh a new Kli Shoreis, was having a Kohen  use it for the first time, during the Avodah.

During the Nes Chanukah  they lit with a new Menorah for the first time.

To be Mekadesh  the new Menorah,required Kohanim to light the Menorah

Mori V’rabi Hagaon R. Shlomo Miller Shlita said with this Rogatchover we understand why we pasken הדלקה עושה מצוה . Chazal wanted to commemorate the Chinuch of the new Menorah ,which required a Kohein to do the
the Hadlakah.

ביום א' התקינו לזכר חנוכת המנורה          
ועוד ז' זכר נס פך שמן

Does Reb Shimon Ben Yochai Agree With The Zohar ?

Shkalim 16b

How were the Luchos written?
R. Chanina ben Gamliel says 5 dibros on each Luach (5+5) 

The Rabonan says 10 on each Luach (10 +10)

R. Shimon bar Yochai says 20 on each Luach (20+20).  
10 in the front & 10 in the back of each Luach. 

R. Simai says 40  on each Luach
(40+40) 10 dibros on all 4 sides of each Luach.

Had this been a  Machlokes in Halacha, we woud definitely  not pasken like Reb Chanina ben Gamliel  who said it had 5 dibros on each Luach. (daas yochid)

It is interesting that all pictures and Luchos in Shuls  depict
5 dibros on each Luach.

The Zohar* also holds, like Reb Chanina Ben Gamliel. that it  had  5 dibros
on each Luach.(5+5)

It seems , the Zohar disagrees with R.Shimon bar Yochai,
who said it had 10 dibros on both sides. (20+20)

Who were the Chachamim Rishonim

The Gemoro brings a Machlokes of Avos Haolom.

 The Gemoro  asks:

“Who were the Avos Haolom?” and answers “ it was R. Akivah & R. Yishmael.”
The Korban Haeidah explains Avos Haolom = Tanaim Harishonim. (early Tanaim)

When the Rambam quotes Chazal, he usually writes Omru Chazal or Omru Chachamim. There are a number of times where he writes
Omru  Chachamim Harishonim (last week)

 The Rambam (Hl. Shabbos  30 : 7 ) writes Omru Chachamim Harishonim

עשה שבתך חול ואל תצטרך לבריות .

 This Mamar is from Reb  Akivah
It is very likely , when the Rambam quotes Ma’amorim from early Tanaim ,

He refers to them as Chachamim Harishonim.

How Many Cups Of Wine On Pesach? Four Or Five

The Rif , Rambam, etc. hold , you are supposed  to drink 5 cups of wine at the Seder.

Just over 100 years ago there was a *Rov who claimed to have acquired a manuscript, found  in the *Royal Library in Metz. 

The manuscript was from the Maharal’s son in law, R. Eliya Katz,  on the Hagadah Shel Pesach.

The manuscript contained two Pirushim, named, “Divrei Negidim and Leshon Limudim” .  

Both Pirushim were (supposedly) written by R.E. Katz quoting the Maharal and his Minhagim.

Up until then, there was only a single Pirush from the Maharal called Gevuras Hashem.(original)

The Rov printed the new *Maharal Hagadah with all three Pirushim.

The truth is, the Rov invented the two Pirushim and claimed it to be authentic Toireh from the Maharal (written by R.S.K.). There are many proofs that it is a fraud.

In the Hagadah he writes, “the Maharal said, people should adopt the Minhag of having a fifth cup at the Seder and say ,Hineni Muchan Umezuman etc. and the Mahral personally,did so as well.”

The truth,
a)      The Maharal, most likely didn’t say “Hineni Muchan Umezuman” for any Mitzvah.
b)      The Maharal writes befeirush that our Minhag is to have only four cups.

The Bain Hashmoshes Question -Pesachim 54b

Bein Hashmoshes , we consider night, Lechumra. (Erev  Shabbos,Tisha B’av etc.)

Why don’t we say every Bein Hashemoshos has a Chazaka that it is day ? 

Whenever we don’t know (safek) when a change happened, Chazaka tells us to assume,it happened at the latest possible time.


Why don’t we consider Bein Hashmoshes Vadai (sure) day, the original status ?  

Answer:

The   ( שמעתא ג' פרק ט'-י' ) *שב שמעתתאsays  חזקה העשויה להשתנות אינה חזקה a
Chazaka that will definitely  change is not considred a Chazaka.
A cow that was found to be Treifoh, Chazaka makes us assume that it happened the
latest possible time. All the milk from before this period is considered kosher .We have a Chazaka
because not  every animal becomes Treifoh. However Every Bein Hashmoshes  will eventually
become night, therefore we have no Chazaka.

It is almost impossible to fulfill this obligation

והייתם נקיים מה' ומישראל

The Chasam Sofer (Shut 6 : 59) writes. "There are two obligations 

1) To come clean from Hashem

2) from Bnei Yisroel. 

It is much easier to fulfill the first obligation than the second one. The punishment for the second
obligation is also much greater. (Chillul Hashem).

You can have a person doing something which is Halachicly  correct, but isn't careful  and some
"שותי שכר" (beer drinkers) mistakenly accuse him of wrongdoing, such a person has not  fulfilled his
obligation of והייתם נקיים .

It is almost impossible to fulfill this obligation. It is likely Shlomo Hamelech had this in mind when he
wrote this אין צדיק בארץ

We find in this weeks Parsha the Bnei Gad etc. followed Moishe Rabbeinu's advice and fought along
with the other Shevatim for 14 years. They were punished  to be sent to Galus before the rest of Klall
Yisroel, because* they haven't fulfilled 100% the obligation of והייתם נקיים ."

Shehecheyonu for Bedikas Chometz

Why do we not say the Birchas Shehecheyonu for Bedikas Chometz?



1) Gaonim : It is a mitzvah that is not always done with Simcha. You might find A nice piece of Chametz and be required to destroy (burn) it.

2) Ba’al Haitur: There is no set time to do the Bedika. If someone leaves his house
In middle of the year and plans to return on Pesach , he is required to do Bedikas Chametz in middle of the year.

3 Meiri : The Mitzva is linked to the Lo Ta’aseh of not having Chametz. On a L.T. no Shehecheyanu
Is said.

4) Rosh : The Shehecheyanu at Kiddush, includes all Mitzvos of Pesach.

Story of the Ba'al Shem

The Gemoro says, the father of Shmuel the son of Rav Yitzchok , learned
“Detoni Avuha d’Shmuel Bar Rav Yitzchok”
a) The father of Shmuel was the son of Rav.Yizchok (R.Y. grandfather of Shm.)
b) The father of Shmuel was Rav Yitzchok ( R.Y. father of Shm.)
a or b ???
The Seder Hadoros has an entry “ Rav Yitzchok Avuha d’Shmuel” (b)
He also has an entry “ R. Shmuel bar Yitzchok” (b)
Seems B is the correct answer, if so, we need to understand why does the
Gemoro say The Father of R. Shmuel the son of Rav Yitzchok? It would
have been much simpler to say R. Yitzchok or R. Yitzchok the father
of Shmuel.
Tosfos (Kidushin 73a dh Mai Ika) brings a Ba’al Shem *story from the Yerushalmi.
The father of Shmuel was in Medinas Hayom (distant country) He came back
using a shem (magic carpet). to his wife and had relations with her(went back).
And Shmuel was born.
They started calling R. Yitzchok “Avuha d.Shmuel” (Father of Shmuel)
In order to publicize that Shmuel was a legitimate son and R.Y. was the father.
From then on he was called and known as Avuha d’Shmuel

Vayokom Melech Chodosh-What's New ?

There is a machlokes between Rav & Shmuel on the Pasuk Vayokom Melech Chodosh
One holds that there was a new king. The other holds it was the same king with
new decrees. (Gezeiros)
The Toras Chaim writes this machloke makes a Nafka Minei (difference) Lahalacha.
If someone sells a newly renovated house as a brand new house, do we consider 
it is a legal sale.
Another Nafka Minei Lahalacha , If someone renovates his home, does he
get sent back from going to war.

This Weeks Daf-The Rebbe With Ruach hakodesh

The Gemoro says that in halachic matters we ignore the Bas Kol , Lo Bashomaym Hee. 

The Torah was given to earthlings to decide Halacha. 


 There was an Aguna , who Bais Din was matir to remarry. After her marriage she moved to a town where a famous great Rebbe lived. The Rebbe said, he can see(ruach hakodesh) this woman’s first husband is still alive, and she must leave her second husband. The Chasam Sofer was very angry and upset with this Rebbe. He wrote to the Rebbe ,that if he disagrees with the Psak Bais Din, then he should , go and bring his arguments in front of Bais Din. To come with Ruach Hakodesh and say the husband is alive he has no right, . Lo Bashomayim Hee.

Chumra Of The Day


 Daf of the week

The Gemoro (Avoda Zarah 53a) and Shulchan Aruch (Y.D. 141-8) say, “You are not allowed
to replicate the shulchan and menorah  etc. of the Bais Hamikdash. The type of metal
or size doesn't matter.  You may not make a seven branch Menorah”*.

The Chasam Sofer (Toras Moshe Parshas Yisro) writes (based on a Tosfos Yoma 54b) that
wood tables may be made, because we  hold, wood tables were posul in the Bais Hamikdosh .
Metal tables may not be made,because any metal table in the Bais Hamikdosh is kosher b'dieved.
The Ch. S. continues that he sees no heter for the matzoh bakery to have copper tables.
The Darkei Teshuva (Y.D. 141-8) argues with the Ch. S. , he writes,
We find  the Gemoro (Shabbos119a) R. Chiya b Aba praised the ba’al habayis who
brought in l’kovod shabbos a golden table. If it would be assur to make, he would
not have praised him.


*There are some poskim who hold that if the branches are not in line, then
even a seven branch menorah is o.k. The  Bchor Shor, Pischei Teshuva and Chida ,
etc. disagree.
They claim that it is assur and not to be meikil (lenient) being we are dealing
with an issur deoriesa.(Lo sa’asun iti elohei chesef--)

(I am just wondering if the same logic would apply to stainless steel tables,
used in commercial kitchens and matzah bakeries etc.. Shouldn't we  be machmir

like the Chasam Sofer, being we are dealing with an issur deoriesa?)

long strides (pesia gasa) on shabbos.

Rebbie asked from R. Yishmael b.r. Yosi  if you are allowed to take long strides (pesia gasa) on shabbos.

R. Yishmael b.y. answered that even in the weekdays it is forbidden." Sheani Omer (because I R. Yishmael say)
Pesia gasa noteles echod meichameish meios mimeor einov shel odom-"
Long strides removes 1/500 of the light from the eyes.

The Ben Ish Chai writes that R. Yishmael prefaced his statement with SHEANI OMER – I
SAY . 
R. Yishmael did not hear this from his father or Rebbe,he said it from his own experience.
R. Yishmael was obese and it was very difficult for him to take long strides. He assumed
that for others who are not overweight it is also strenuous.
The gematria of PESIAH GASA (bemilui- Pei= pei+ hei etc.) equals 570.  The same as
yovad echad mtav kuf.(he will lose 1/500)

Tomid B'simcha

R.Noson Sternhartz wrote that R. Nachman Breslover said ,

"Mitzvah Gedolah Liyhos B’simcha Tomid."

1)  What makes this a mitzvah?      None of the monei hamitzvohs
count this as a mitzvah.  It is true , that mitzvahs should be done
besimcha. This is a way to do the mitzvah but not a mitzvah in itself.

2)  How can you say “Tomid” if there are times when not only
is it not a mitzvah but an aveirah ?
In Hl Aveilos # 391 – 1  Aveil  asur liyhos b’simcha .

3)  Why is this, a mitzvah gedola and other mitzvahs are not gedola?

I found only one mitzvah gedola in the whole Shulchan Aruch  
“Mitzvah gedola l’haspid hameis  koroui” ( It is a great mitzvah to eulogize
a niftar properly).

There is one more mitzvah where gedola is mentioned
Hl. Pidyon Sh’vuyim “ein lecho mitzvah gedola k’pidyon sh’vuyim.
PS. I have no answer to the questions,

 Yehi ratzon, the day of "B'simcha Tomid" should arrive b'karov mamash.

The Gematria of Mekoshesh equals Shabbos +38 .The Mekoshesh kept shabbos by
refraining from 38 melochos. One melocho, he  didn’t refrain from, and was mechallel
Shabbos.*
There is a Machloko in the Gemoro which one it was.  a) Tolesh - b) Meamer -c) Mavir daled amos.

Making Kiddush on Yom Kippur is a מחלוקת between ר' עקיבא איגר   who holds it is only a  מצוה דרבנן  unless it falls on...
