Vort On This Weeks Parsha -Achrei Mos- Kedoshim

Vayikra 16 : 21 the Pasuk says ,
The next Pasuk (22) it says again

R. Y.B. Soloveitchik zt”l (Boston) explains*, there were two Shlichos done.
In Pasuk 21,The Meshaleiach (sender) was the Kohen Gadol. The Ish Iti was the Shliach
of the Kohen Gadol (Ahron) . His mission was to bring the שעיר   into the Midbar. As
soon as it arrived in the Midbar, The Kohen Gadols responsibility was done with. At
this point the K.G. may do the Krieah (reading) of the Parsha.
This is what the Mishna is telling us,

In Pasuk 22 the sender is not the Kohen Gadol but the Ish Iti . (for Klall Yisroel)
The Ish Iti sends (delivers) the שעיר  to the צוק
                                                                                                                                                                                                                                                   ובזה  מיושב הרבה דיוקים
                                                                                                                                                                                                         * שיעורי הגרי"ד

The Ish Iti always died within the year. They picked a person whom

they knew (בקי בחכמת המזלות ) wouldn't survive the year.

Parshas Matos

The Chasam Sofer (Shut 6 : 59) writes.

 "There are two obligations

1) To come clean from Hashem

2) from Bnei Yisroel.

It is much easier to fulfill the first obligation than the second one.

The punishment on the second obligation is also much greater.
(Chillul Hashem).

You can have a person doing something which is Halachicly  correct, but isn't careful  and some "שותי שכר" (beer drinkers) mistakenly accuse him of wrongdoing, such a person has not  fulfilled his obligation of והייתם נקיים(מישראל)  .

It is almost impossible to fulfill this obligation. It is very likely Shlomo Hamelech had this in mind when he wrote

We find  the Bnei Gad etc. followed Moishe Rabbeinu's advice and fought along with the other Shevatim for 14 years.

They were punished  to be sent to Galus before the rest of Klall Yisroel, because they haven't fulfilled 100% the obligation of והייתם נקיים ."

PARSHA & DAF HASHAVUA-Who Is First ?

PARSHA & DAF HASHAVUA

The רשב"ם explains that when the Torah is referring to their marriage then it lists them in the order of their age because the norm is for the older one to marry before the younger one (and that's how it actually happened).

Some Poskim say that this rule of not marrying off a younger sibling before an older one applies only to females.

Males who have the Mitzvah of פרו ורבו there is no reason of holding back the Mitzvah because of an older brother who is not married yet.(  אג"מ-מהרש"ם)

Some want to prove this from נדב ואביהוא. Chazal tell us one of the reasons they were both punished was for staying
single and not getting married. If אביהוא would have had to wait for his older brother נדב to get married then why
was he punished.

This is not really a proof because if the older brother refuses to get married then there is nothing to wait for and there is
an obligation for the younger brother to get married.  Once נדב refused to get married then אביהוא was obligated
to get married and yet he didn't, therefore, he too was punished.

The ש"ך (Y.D. 244:13) quotes the ב"ח " Both, brothers or sisters should not marry the younger one before
the older one".

R.Moishe Feinstein zt"l (Igros M. E.H.2:1) says that the ב"ח is only applicable if both are engaged only then must
we marry off the older before the younger.

A younger sibling (even sister) may get engaged before the older sibling and get married if the older is not engaged yet.

The   (מהרש"ם (ח"ג קל"ו  says that this Halacha is not a דין גמור but a Minhag Derech Eretz. Therefore in certain
cases ("בעושה משום דחק") it is permitted.
