the משל from the Brisker Rav zt"l

He explained the different periods of the ימים נוראים starting with, אלול,ר"ה, עשי"ת and finally יום כיפור with the following משל.

There once was a wealthy merchant trying to smuggle across the border a large quantity of merchandise.

He hired a professional smuggler who knew the route and
best time to cross the border not to get caught.

The plan was to load the wagon with the merchandise
weeks before. The wagon driver will hang around in the
forest near the border and wait for the smuggler to give
him the signal when to cross the border. He would then rush his galloping horses and cross the border.

The merchant starts worrying and can't sleep at night as soon as they load the wagon

The smuggler worries and can't sleep at night after he gives the signal to cross.

The wagon driver worries when he gets within a hundred feet from the border.

The young boy who does the loading and unloading is only worried after the guards approach him with the guns pointing in his face.

After getting caught all are worried except for the horses. They are even happy that they can have a rest now.

Some are makpid to stand on Yom Kippur during the whole Davening to imitate the מלאכים.

Poskim* say that this Chumra doesn't apply to women since there are no female מלאכים.

There are other Poskim who say they should not say on Yom Kippur בשכ"מ loud for the same reason.

The **ספר אורח נאמן writes that for the same reason women need not keep their feet together when Davening שמונה עשרה.

aloud, to imitate the מלאכים.
According to the שו"ע הרב, in order to imitate מלאכים, 

בשכמל"ו needs also to be said in a standing position*. 


*Yom Kippur is the only day in the year when one may stand up to say קריאת שמע

מנהג של שטות


 מנהג כפרות בערב יו"כ מנהג של שטות הוא 





"Minhag Kaparos on Erev Yom Kippur is a Minhag Shtus"

The Mechaber in Shulchan Aruch O.Ch. Siman # 605, writes that you should refrain from the Minhag כפרות with chickens.

In the Bais Yosef on the טור he quotes the Ramban who writes that it is
אסור because of דרכי אמורי.

The Rema defends the Minhag and says it is an old Minhag and we should follow it since it originates from the Gaonim.
It is interesting that Sephardim who always follow the Bais Yosef and
yet when it comes to כפרות they follow the Rema.


The first eighteen editions of the Shulchan Aruch (first 4 during the lifetime of the Bais Yosef)  had this header 
 "מנהג כפרות בערב יו"כ מנהג של שטות הוא"
In the later editions of the Shulchan Aruchs, the words מנהג של שטות הוא was removed.

It is unknown who decided to remove it. We have today numerous new
editions of Shulchan Aruchs reprinted with corrections on the text etc.
Not a single one of them put back the original text of this header.

From the Shach in חו"מ שפ"ו ס"ק ד, we see clearly that he held that the Mechaber(Bais Yosef) himself is the one who wrote the headers for every Siman in Shulchan Aruch.

Ever Wonder What צום קול ממון was doing in the Machzor

In most  Ashkenazi Machzorim, above the words of  
   ותשובה ותפילה וצדקה there appears  three words צום קול ממון .

What is the connection of Tzom to Teshuvah & Kol to Tefillah?

The Rambam Hl. Teshuva enumerates all the ingredients for Teshuva -(Azivas Hachet, Charata, Vidui and Kabala Al Ha'asid) but no mention of fasting.


The Gemoro says that those who think you need Kol for Tefillah are from the small believers. Wouldn't Kavanah be more appropriate for Tefilah?


Why is it important to tell you Tzedakah is money (Mammon)?

Perhaps, "Tzom, Kol, Mammon"  has no connection  to "Teshuva, Tefillah Utzedokoh", but is a different formula for a different occasion.

     Mavirin Roa Hagezeirah can be interpreted two ways:

1) Prevents bad Gezeiros from ch”v coming.


2) Removes (rids) bad Gezeiros that ch”v arrived already  .


To prevent bad Gezeiros  from coming, the formula is Teshuva, Tefilla and Tzedaka.

To get rid of bad Gezeiros that has ch”v arrived then the formula is as mentioned in The Rambam in Hl.Taniyos . (based on the Mishna Ta,anis 12b)

(א- הל' ד') ומדברי סופרים להתענות על כל צרה-   
   There is a mitzvah d’Rabanan to fast.                    
                                   Kol
(א- הל' א') מצות עשה מה"ת לזעוק ולהריע בחצוצרות
 Mitzvah min Hatorah to blow trumpets& scream
to Hashem.
                                      Mammon*
  (ג' הל' ד'- הל' ח') ונועלין את החניות- ממעטין במשא ומתן
You close the shops- reduce business dealings.


*(Mammon is not Tzedokoh but loss of monetary income)
It's very possible that during the Holocaust years it would
have been more appropriate to say Tzom Kol Mammon,Ma'avirin
es Roah Hagezeirah  instead of UTeshuva UTefilah

At the end of התרת נדרים, after the Bais Din said הכל יהיו מותרים לך,
one  is מוסר מודעה (notifies Bais Din) and says  that he nullifies
from now on all future נדרים ושבועות etc.

According to Harav S.Z. Auerbach Zt"l, There is no need
to nullify the future נדרים etc. in front of a Bais Din.
One can say the Nusach at home. There is no
need to be מוסר מודעה to Bais Din of his intention.
