Daf Hasavua Nedarim 31 b-Mila On Shabbos

Harav Yosef Sholom Elyashuv zt"l originally held that children born through artificial insemination may not have their Bris done on Shabbos.

In later years he changed his mind and allowed the Bris to be Doche Shabbos on such children.

Harav Ezriel Auerbach shlita explained his Shver as follows:

Based on a Rabbeinu Chananel, artificial insemination is considered Ma'aseh Nissim and therefore would not be  Doche Shabbos.

Since artificial insemination became a very common practice, it is no longer considered Ma'aseh Nissim and is Doche Shabbos.

I was wondering, recently a 60 year old woman gave birth to a boy. What would have happened had she given birth on Shabbos, would it be allowed to perform the Bris on Shabbos. (Ma"aseh Nissim).

How Did The Steipler know the Rosh Yeshiva was drunk? ANSWER HERE

 There  once was a Rosh Yeshiva 

who said on Purim that  they can ask him 
any question in ש"ס and he will have an answer.

They asked him from the גמרא נדרים דף ח  a+b
"If someone dreamt that he was put in חרם and
they were also מתיר his חרם , he must be מתיר
his חרם  again after awakening. 

Because we must assume part of the dream might be true and part not to be true, We assume the true part of the dream was being put in חרם and the untrue part of the dream was they were מתיר him".

They asked from the Rosh Yeshiva,
"why don't we assume the opposite, that the untrue 
part was being put in חרם and the true part
was them being מתיר the חרם, and he wouldn't 
need another היתר after awakening?

The R.Yeshiva answered that according to
the ראשונים who hold חרם  is דאורייתא and even if it is
only דברי קבלה, when there is a   ספק we need to go
לחומרא and assume he was put in חרם and didn't
have a התרה

The Steipler said, " from the answer he gave,  you
can tell the Rosh Yeshivah was drunk."


The question doesn't even begin
( no need for the Rosh Yeshiva's answer}

The only possibility for part of the dream to
be true is if he was put into חרם.

If he wasn't put in חרם (untrue part) then
the התרה will also be untrue since there
was no חרם there is no התרה.

ר' יהודאי גאון writes, "For more than one hundred years both yeshivos (Pumbedusa & Sura) haven't been learning מסכת נדרים" "אנן לא גרסינן נדרים ולא ידעינן לאסור ולהתיר בה לא נדר ולא שבועה" This might explain why we have no Rashi on Nedarim  It will also explain why the entire  מהרש"א חידושי הלכות has no Chidushim but only corrections in the Girsa. When R. Yehoshua Shlomo and his son R Gershom Soncino,  printed the first   ש"ס  they printed only those Mesechtos the Yeshivos were learning. Ms. Nedarim was not printed because it was one of the Mesechtos not learned in the Yeshivos Danielle Bomberg*( a Goy) who got permission from Pope Leo X was the first one to print the entire ש"ס  ** including Ms. Nedarim. It was only after the printing of the Bomberg Shas, that Meseches Nedarim became part of Shas and Yeshivos started learning it.   If not for Bomberg the Goy & Pope Leo X, Ms. Nedarim might not have been part of the Daf of today. *born in Antwerp Belgium ** printed in Venice 1520 -23

DID YOU KNOW?  (272) The only Mesechte in the entire Shas that has a header on top of every page with the word "רש"י" , is, in Meseches Nedarim. The irony of it is, the פירוש under the header is definitely not Rashi. Some claim it was written by the Rivan*, son-in-law of Rashi.
