The 讟"讝 (Y.D.116:6)
forbade because of 住讻谞讛 to cut down fruit
trees" Isn't it the Torah
who forbade cutting down fruit
trees?
Perhaps, if we change
on the 讟"讝.
The Torah
forbade us to cut off the fruit tree. Chazal
said* that it is a 住讻谞讛* to cut off the fruit tree.
*As far as I
know, this is the only Mitzvah in the Torah where Chazal teach
us that it is dangerous to be 注讜讘专 the 注讘讬专讛
** Most Poskim
including the 讟"讝 allow cutting off the tree when the benefit is
greater than the tree. They are not concerned in such cases
