The real reason

                                     The real reason

The קרובץ לפורים is on every Bracha of the שמונה עשרה except on the Bracha “את צמח”.

Some claim the reason for this is, "All the wars were fought by מלכות בית דוד except for מלחמת עמלק which were fought by the grandchildren of Rochel. Mordechai was מתקן for Shaul Hamelech's war on אגוג. Therefore we don’t mention the נס when saying "את צמח דוד ."

The truth is, קרובץ, were written not only for Purim. There are
קרובץ for Hoshana Rabah,17th Tamuz, 10th Teves, and 9thAv. They all have no קרובץ on את צמח.

The פייטן for
קרובץ was R, Elazar b Hakalir. In his פיוטים, he generally follows the Yerushalmi over  Bavli.

According to the Yerushalmi, the Bracha of את צמח and וירושלים עירך, are combined into one Bracha.

Hence, no
קרובץ for  את צמח

Megillah Leining (מוצש"ק)

                    Megillah Leining (מוצש"ק)

In Meseches Sofrim (14th Perek) it says that the Minhag is to read the Megillah the first two Motzei Shabbosos before Purim.

The first  Motzei Shabbos in Adar you read till בלילה ההוא. The second  Motzei Shabbos (tonight) you start from  בלילה ההוא
till the end.

It is unknown the reason or the source for it.

Zecher or Zeicher- What's the issue

Zecher or Zeicher- What's the issue
?

The word for “memory” is apparently “zeicher” (Tehillim 111:4). The question is whether “memory of”
(סמיכות)
changes to zecher.

According to the Mesora, it is Zeicher and therefore in Ashkenazi Shuls (Yekes) they don't repeat it since Mesora
overrides Dikduk.

I think it is the Mishna Verurah to be one of the first Poskim who writes to repeat it twice*, although Minhag Chabad &
other Chasidim is to do so as well.

*There seems to be a Machlokes between R.Chaim Volozhiner & the Ma'aseh Rav how the Gaon read it and if he changed his mind later on in life.

Did you know ? #123

Netilas Yodayim for the Megillah

According to the Rema (O.Ch.147:1), You should not touch the Megillah with your hands unless you did Netilas Yodayim (wash hands) before doing so.

The Clipper

The Ibn Ezra (Koheles 5) criticizes the Piyutim of the Kalir.*

He has four main complaints against them.

1) Most of them are Chidos (riddles) & Mosholim (parables)

2) Instead of Loshon Hakodesh he mixes in Loshon Hatalmud

3) He invents words & uses improper Dikduk (poetic license)

4) They are based on Medroshos & Agodos instead of Pshat

The Teshuvas Maharashdam (O..Ch 35) claims,
The Sephardic Paytonim  have a simpler and easier
language. Everybody can understand the Piyut, whereas the
Ashkenazi Paytonim use difficult words and even the
Shatz (Chazzan) doesn't understand what he is saying.

He recommends Ashkenazim to switch to Nusach Sefard,
which is a superior Nusach.  He claims "Al Titosh Toras
Imecha is only applicable when there is a small Issur involved
and not for changing a Nusach Hatefilah.

The Chasam Sofer (Hagohos O.Ch.68) writes that "the Mahrashdam
wasn't aware of the Magen Avraham (68) who writes. you are
not allowed to change the Nusach Hatefilah because
there are 12 gates in heaven, one for each Shevet. Each one
has his own Minhag. The Yerushalmi says, they are all equal
you should not change from the Minhag of your fathers."

Had the Maharshdam been aware of this M.A., he wouldn't
have written what he wrote".

Piyut of the Kalir starts with

Buried in Gush Chalav

רבי מאיר בעל הנס

According to the Yerushalmi (Kelaim 9:3), R. Meir died in
(חוץ לארץ (אסיא  and his body was placed in the sea in חו"ל.

The first source that mentions  R. Meir’s burial place
in E. Y. is in the Sefer גלילות ארץ ישראל. He writes that R. Meir
the Tanna is buried in the city of Tveryah.

The Seder Hadoros  quotes the same  Sefer גלילות א"י
who writes, " R. Yitzchok from Gush Chalav and
R. Meir Baal Haness are both buried in Gush Chalav. The
Gelilos E.Y. also writes that he doesn’t know who they were.

R. Yakov Lipshutz in his  Sefer Zichron Yakov  (vol 2 p 30) writes,
"The pushkes  for the poor in Eretz Yisroel  were  named after  an
Ish  Chasid  V’kadosh who lived in Eretz Hakodesh a few hundred
years  ago. He was famous – and was called R. Meir Baal Haness”.

Two of the most prominent and respected Frum historians
(R. Yechiel Heilprin- Seder Hadoros  & R. Yaakov Lipschutz -
Zichron Yaakov ) both believed, that R. Meir Baal Haness
and the Tanna R.Meir were two different people.

 1)                       R.M. is buried in Tveryah    RMBH is buried in Gush Chalav

 2)                       Seder Hadoros & Gelilos E.Y.  both don’t know who R.M.B.H. was

 3)                       Zichron Yaakov claims R.M.B.H. lived a few hundred years ago
R.M. the Tanna lived two thousand years ago.

  4)                     To donate  L’iluy  Nishmas a Tanna who was niftar 2,000 years ago
                           sounds  strange.
A Neshama from 2000 years has reached its peak a long time ago.

  5)                    The hundreds of Tanoim & Amoraim most of whom were
also, מלומדים בנסים   yet their Neshama doesn't need an Aliyah
and the Tanna R.Meir  needs our Zchusim for his Aliyas Neshama.

  6)                     The Loshon, בעל הנס is not found in Shas.  In Gemoro

,                           we only find the term מלומד בניסים.

Who Was He

Who was רבי מאיר בעל הנס?

a) Tanna R.Meir
b) R. Meir Arik
c) R. Meir Premishlan
d) R. Meir Kahane

e) None of the above

אלהא דמאיר עניני- Its Not A Name

אלהא דמאיר עניני

According to the אגדות המהרש"א  (Avoda Zarah 18a)  the correct answer is (e)

The מהרש"א says, "It can’t refer to the Tanna R.Meir* because he was still alive. In his lifetime** he would not use
his own name attached to  Hashem's name".

The מהרש"א says “ מאיר is not a name. It is a word, המאיר who lights up the world. (המאיר לארץ ) Hashem who lights up the world (present) should help me

Or, "אלהא דמאיר" Hashem who lit up for us during the dark days of the Greeks withthe נס of Chanukah”. (past) He shall bring  Nissim and save me.

Caveat emptor

In Shulchan Aruch,(CH. M.   232:19 ) it states
Minhag is Mevatel (nullifies) the Halacha ( מקח טעות)
Today we can't claim   מקח טעות
(The buyer is stuck with the spoiled eggs and can't claim מקח טעות  )
Harav Elyashiv ruled this Halacha/Minhag is only applicable when
someone sells  for profit since the Minhag in the business world
it is acceptable to claim a final sale - Caveat emptor.
However a woman borrowing eggs since there is no profit, then
the original Halacha of מקח טעות kicks in and it is applicable.
Therefore she hasn't acquired the egg and is not responsible
to pay for it*.

The Shevet Halevi (10:133) writes "A woman who borrowed a dozen
eggs and two of them had bloodspots, She might not be
allowed to return a dozen eggs because there might be
a problem with Ribis (D'Rabonon)

*She is also not responsible for destroying the egg since it has no value

ואלה המשפטים

ואלה המשפטים
Rochel borrowed an egg from her neighbor. She cracked it
open and found a blood spot, so she threw it out.
Does Rochel have to repay an egg to her neighbor?

Shulchan Aruch Choshen Mishpat  232:19
“If someone sells eggs to his friend and it was found to be
spoiled and inedible, It is considered a Mekach Ta'ous,(mistaken sale)
and the money must be returned. Today we don’t rule
like this. And a Minhag is Mevatel (nullifies) a Halacha”
(The buyer is stuck with the spoiled eggs)
This is the Halacha in Shulchan Aruch that we follow the Minhag instead of the Halacha.

Accordingly, we would think, the same rule applies to Rochel.
She is stuck with this egg and has to repay an egg to her
neighbor.
R.Y.S. Elyashuv zt”l ruled, Rochel doesn’t have to pay back
the egg.

WHY NOT ???
