Parshas Hashavua עקב  הכל בידי שמים חוץ מיראת שמים רש"י י' י"ב   The Rambam (איגרות הרמב"ם) rejects the חז"ל of ארבעים יום קודם יצירת הולד בת קול יוצאת ואומרת בת פלוני לפלוני. The גמרא קידושין מ says that if a person can't control himself from committing a עבירה, he should go to a place where he is unknown and dress in black. Some Rishonim (רי"ף, רא"ש ועוד) claim that we don't Pasken like ר' אליעאי, who believes there are times when a man can't control himself and has no בחירה. We hold that הכל בידי שמים חוץ מיראת שמים, meaning every sane person has control and the בחירה of not committing a עבירה. R. Elchonon Wasserman הי"ד writes that the רמב"ם agrees with the רי"ף, stating that we Pasken הכל בידי שמים חוץ מיראת שמים, and not like ר' אליעאי. The רמב"ם holds that the גמרא of ארבעים יום קודם יצירת הולד is only according to ר' אליעאי, who believes there are times of not having בחירה. Therefore, the רמב"ם rejects the גמרא of ארבעים יום קודם יצירת הולד.
