Watch Yourself

Parshas Hashavua
ואתחנן


                ונשמרתם מאד לנפשתיכם
דברים ד:ט"ו    


This פסוק has been quoted the past few months
by countless Rabonim, Poskim, Roshei Yeshivos,
Doctors, Hatzoloh members, etc.

Many will be surprised that this פסוק has nothing
to do with not to endanger one's life.

נפשתיכם refers to the נשמה and not the body.
The פסוק is commanding us to be extra
careful not to carve forms of animals etc. ending
up bowing to them and being עובד עבודה זרה.
It has nothing to do with endangering human lives.

The only one who referenced this  פסוק to 
endangering human lives was a non-Jewish שר (minister)

No Need To Learn

    Is there a חיוב to learn on תשעה באב?


The ספר שבט יהודה יור"ד ס' שפ"ד ס"ד* has a חקירה

" When Chazal said one may learn דברים רעים does
this mean that there is a חיוב of תלמוד תורה but limited
to only דברים רעים

or do we say that an אבל or on ת"ב there is no
חיוב תלמיד תורה but Chazal came up with a היתר of
learning דברים רעים if one wants to learn but there
is no obligation to do so"

The שבט יהודה concludes that there is no חיוב of
תלמוד תורה and one is not obligated to learn at all.

WHOSE FAULT WAS IT?


The Bais Hamikdash was destroyed because of
Kamtza and Bar Kamtza. (Gittin 55b)
1) Why was קמצא at fault? (He didn't do anything)
2) Why wasn’t the בעל הסעודה at fault?
Shouldn’t he be the number one culprit?
3) Why were the רבנן who kept quiet at the
meal, not at fault?
4) The Gemoro on 56a said it was ר' זכרי' בן אבקולס fault.


Everyone involved in the מחלוקת is at fault

When the Gemoro says "because of Kamtza & Bar Kamtza
the Bais Hamikdash
 was destroyed", The Gemoro doesn't
blame these two people. The Gemoro says because of the story of Kamtza & Bar Kamtza,  the Bais Hamikdash
was destroyed.

In the story, there are, many whom we can blame.
1) Bar Kamtza, 2) Ba'al Haseudah,
 3) Rabonon and
even 4) Kamtza*


*The Ben Ish Chai writes "Kamtza which means
Grasshopper was a code name
 for R. Zecharya ben Avkulas"

When Did He Die

 מת בי"ט ראשון יתעסקו בו עממין בי"ט ב' יתעסקו בו ישראל

WHEN WAS THE בעש"ט NIFTAR?
WHO DID THE TAHARA & KEVURAH?​

In a Ksav Yad (manuscript) from the son of the Toldos it is written
"The בעש"ט was Niftar on the first day of Shavuos 6th of Sivan on a Wednesday".

Many other Seforim follow this Mesorah (tradition) and agree
he was Niftar on the first day YomTov.
​T​he Sefer Melietzei Aish and some other Seforim claim
The בעש"ט was Niftar the second day of Shavuos. (can't be on a Wednesday)


The previous Skolye Rebbe zt"l said There is a Mesorah that the בעש"ט said  " At my Yetzias Neshama all clocks in Meshbuz will stop".

The בעש"ט was Niftar the second night Shavuos at midnight
and all the clocks in Meshbuz stopped exactly at12.00

(I wonder how many clocks, if any, Meshbuz had in those days)


The Darkei Chaim V'sholom (Minchas Elozor) writes The בעש"ט was Niftar on the first day Yom Tov and the Chasidim followed the Halacha יתעסקו בו עממין to have Goyim take care of the body and the Kevura.

The Sefer Shemuos V'Sipurim writes " R. L. Y. Schneerson zt"l asked from The Lubavitcher Rebbe The Marshab zt"l
(R. Sholem Ber) 

Who took care of the body of the בעש"ט ?" (YomTov)

The Marshab answered" the body of the בעש"ט didn't require others to take care of it.

A different version of his answer "The בעש"ט buried himself.after his Petira, no grave diggers were needed."

The רמ"א (O.Ch. 551: 1) writes, On שבת חזון, you  must wear weekday clothes (except the shirt)

The ערוך השלחן תקנ"א : י"א  writes, "today we do change to בגדי שבת. They were מתיר
 wearing  בגדי שבת, otherwise, you will be showing אבילות בפרהסיה (public) on Shabbos.

Even though the רמ"א also knew of the problem of אבילות בפרהסיה,  he still wouldn’t  allow
wearing בגדי שבת because in the times of the רמ"א the style of dress between Shabbos and 

weekday were similar. By wearing weekday clothes there is no אבילות בפרהסיה. 

It is only  when they started wearing Bekeshes and Shtreimels on Shabbos were they  מתיר
to wear בגדי שבת otherwise, it would be אבילות בפרהסיה".

According to the ערוה"ש  the Heter of wearing בגדי שבת is only for Chasidim who wear
on Shabbos Shtreimels and Bekeshes. Those who wear suits and hats on Shabbos should wear

 their weekday suit and hat.

The Palestinians

The פייטן in קינות לתשעה באב #37 writes,
"בך כל בהמה ועוף חכמו עדי כחמור היה לפנים לבן יאיר חמוריך"

"Within you (Zion) every animal & bird grew wise to the point where even the donkeys were as intelligent as the donkey of (Pinchas) Ben Yair".
(ie: Animals in Eretz Yisroel are smarter than Chutz La'aretz animals)

It is claimed, that the most intelligent Arabs, are the Palestinians.

Perhaps, the reason for it is, because if אוירא דארץ ישראל has an effect on the חמורים it surely must also have an effect on the עם הדומה לחמור

However, we must apply the Talmudic rule of דיו לבא מן הדין להיות כנדון.


In a קל וחומר we limit the חומר to the same measure as the קל.
Therefore the קל וחומר teaches us that the ישמעאלי has as much
intelligence as the Israeli חמור but not more.

Mori V'Rabi Harav Hagaon R. Shlomo Miller Shlita said during Shiur this week:

"From the Halacha of not
being allowed to wash even clothing that will not be worn
on שבוע שחל בו ת"ב we can see the severity of not being
מסיח דעת of the Churban during the 9 days. 

The משנה ברורה תקנ"א ס"ק כ"א explains the reason for not doing
laundry is because it looks like he is מסיח דעת.

If it just looks like being מסיח דעת is wrong to do so קל וחומר
how much more so when one is actually מסיח דעת"

Most controversial Teshuvas Chasam Sofer

מוהלין ופורעין ומוצצין




 Of the 1246 printed תשובות חתם סופר there is one תשובה that stands out as being the most controversial one the חתם סופר ever wrote.

This תשובה was kept out of the original printed תשובות חתם סופר and wasn't printed (in Teshuvas Ch.S.) only until recently. (Biton edition) 

The Ch.S. writes that מציצה בפה is not mentioned in Halacha but is
only done according to קבלה. He then adds to it אין לי עסק בנסתרות
ie: I don't get involved in קבלה and not too concerned about it.

He continues and writes that even if the Mishna would have 
written to do
 מציצה בפה we wouldn't have had to do it today since it
isn't part of the Mitzvah but done only for medical reason, if it can 
be performed in a different manner (no mouth) it would be OK 
to do so.

Some Gedolim claimed this Teshuva to be a fraud that was made up 
by the opponents of מציצה בפה.
This was proven to be incorrect.The original Teshuva exists today
and is in possession of family members of R Yisroel Stern's a"h (London}

The מהר"ם שיק and others claim that this Teshuvah was a הוראת שעה
(extenuating circumstance) and may not  be used today as a היתר not
to do מציצה בפה.

Even though the Ch. S. doesn't mention it to be a הוראת שעה and from the לשון of the Teshuvah it doesn't seem to be a הוראת שעה we must accept the assumption of the מהר"ם שיק of הוראת שעה and we can't use this Teshuvah as a היתר from the חתם סופר not to do מציצה בפה

THE YOM TOV OF כ"ו תמוז?



 
In 1916, a bookseller named Naftali Zvi Shapiro offered to sell to Abraham Kahan, letters written by the Baal Shem Tov that had been stored in some Geniza (cache of old documents).

There was confusion as to the origin of the Geniza.

In 1921, the letters appeared again in Odessa, having originated
(supposedly) in the government archive in Kherson. This cache was supposedly confiscated from the Ruzhiner Rebbe zt"l.
when he was put in prison.

The story that went around was that in the confusion following
the revolution in 1917, the letters were removed from the
Kherson archive and brought to Odessa. There most of the
letters were purchased by ​a wealthy Chasid, Shmuel Gurary who presented them to ​his Rebbe the Maharshab, Harav Shalom Dov Ber zt"l.
.

In the 1930s, Rabbi Yosef Yitzhak, zt"l (Frierdiger Rebbe)
published some three hundred letters, purportedly from
the pen of the Besht etc. in the Chabad journal, Hatamim.

It soon became apparent, that the authenticity of the
manuscripts was questionable.
Close inspection of the contents, form, and paper cast serious
doubt on their genuineness

Today, outside of Chabad there are virtually no authorities who consider these letters anything other than forgeries.

Scholars examined the letters from the Kherson 
Geniza attributed to the Baal Shem Tov and matched up the dates
to the day of week in which they were written. it was discovered that some of the dates coincided with Shabbosos & Yomim Tovim. Also, the type of paper that was used on the manuscripts was not yet available then.


Even in the Chasidic camp, these letters were claimed as forged
The Imrei Emes (Gerrer Rebbe) ,R. Yisochor Dov Rokeach (Belzer Rebbe), and Minchas Elozor (Munkatcher Rebbe) zt"l
all took issue with the authenticity of these letters.

Outside of Chabad there are no sources that suggest they were not forgeries.

The last Lubavitcher Rebbe Zt"l who was an expert on old Seforim and manuscripts insisted that they are indeed authentic and
wouldn't give in to the academics who tried to convince him otherwise.

In the Sefer Hatamim, there are two letters from the Kherson Geniza
re the Yom Tov of כ"ו תמוז. The בעל שם טוב declared
this Yom Tov to be celebrated by all future generations forever.


As far as I know. no one, not even Chabad celebrates כ"ו תמוז
as a Yom Tov

             כיסוי קרקעות אם יש להן בית אחיזה אין אי לא 

 According to Mori V'Rabi Harav Hagaon R Shlomo Miller שליט"א
 One may remove and/or return the cover of the toilet tank on שבת.

 Even though it is a cover to a מחובר לקרקע {toilet) and should
 need a handle* (בית אחיזה) but since it is easily removed by holding
 on to the sides, it is considered as if it has a בית אחיזה



Otherwise, it is like בונה

Brisker Chumra

ושבעה עשר בתמוז הפך לנו לשמחה ולששון*

The  Brisker Rav said in the name of his father R. Chaim,  "when Chazal established the four fasts, It was not that they established the fasts and then exempted the חולה (sick) from fasting.
They established the fasts specifically only for healthy people and not for the sick.
Therefore, there is no point for a חולה to be Machmir in fasting. If one does go ahead and fasts it is not considered participating in the fast". 

Some Poskim** add that according to R.Chaim if חולים are part of and are needed to complete the Minyan then you might not be allowed to Lain 
ויחל since there is no Minyan of Yidden who are participating in the fast even if all ten are fasting.  

Mori V'rabi Harav Hagaon R. Shlomo Miller Shlita said in jest that perhaps we can add one more Brisker Chumra, "not to give an Aliya on a fast day to anyone who might be a חולה."
