However, if this relative is not Frum and he is not a תינוק שנשבה (grew up in a Frum home & went off the Derech, etc.), or a suicide victim, being there is no דין אבילות** for them, the כהן may not be מטמא himself. Perhaps, even a ספק תינוק שנשבה or a ספק מאבד עצמו לדעת might be problematic for a כהן to be מטמא, since we are dealing with an איסור דאורייתא*** of טומאת כהן אמבצי *Father, mother, brother, sister, son, daughter, wife **The רמב"ם הל' אבל פ"ב ה"ח holds טומאת כהן is dependent on אבילות *** ספק דאורייתא לחומרא
