 RIDDLE 

a) Because the meat he ate was טריפה, he won't      get killed

b) Because the meat he ate was at a party with      music he won't get killed.
?


The רמב"ם (ממרים 7:2) rules that a בן סורר ומורה is exempt from the death penalty if the meat he consumes is either:

  • אכילת עבירה →eg: eating non-kosher meat.

  • אכילת מצוה →eg:  eating at a סעודת מצוה.

The רמ"א (O.C. 670:2) writes that זמירות ותשבחות (songs of praise) transform a Chanukah party from a mere סעודת רשות into a סעודת מצוה.

The Mishnah Verurah (ס"ק ח) adds that even a wedding of an עם הארץ to a בת תלמיד חכם is considered only a סעודת רשות—unless they include זמירות ותשבחות, which elevate it to a סעודת מצוה.

Hence:
A בן סורר ומורה who ate the meat at a Chanukah party accompanied by singing (זמירות ותשבחות), or he ate טריפה meat, he would not be חייב מיתה.
